UGC terms
Last updated 22 October 2026
In short: from KSh 600 per video, the brand’s budget sets the final rate, we hold payment until approval, and ClipGanji keeps 5%.
1. Who these terms cover
These terms apply to creators who list a UGC profile on ClipGanji (“creators”) and to businesses that request or buy UGC through ClipGanji (“brands”). They sit alongside our general terms of use. ClipGanji is operated from Nairobi, Kenya.
2. Rates and the 5% ClipGanji fee
Videos start at KSh 600. A creator’s listed rate is a guide; the final rate for each job is agreed from the brand’s budget and confirmed in writing (email or WhatsApp) before work starts. ClipGanji keeps a flat 5% of the agreed job value as its fee. The creator receives the remaining 95%. There is no fee to list a profile.
3. Payment held until approval
Brands pay ClipGanji in full by M-PESA (or another method we confirm) before filming starts. ClipGanji holds the payment and releases it to the creator only after the brand approves the content, or after the review window in section 6 ends without a response.
4. Payout timing
Approved jobs are paid to the creator’s M-PESA number in their own name, normally within 3 working days of approval. M-PESA transaction charges on payouts are covered by ClipGanji. We may hold a payout while a dispute or fraud check is open.
5. Delivery timelines
The creator delivers by the date agreed in the confirmed brief, which defaults to the delivery time shown on their profile. If a creator cannot meet a deadline, they must tell ClipGanji before it passes. Work delivered more than 5 days late without agreement may be cancelled, with the brand refunded in full.
6. Review and revisions
The brand has 5 days from delivery to approve or request changes. One round of reasonable revisions within the original brief is included. New ideas, reshoots or changes outside the brief are quoted as extra work. If the brand does not respond within 5 days, the content is treated as approved.
7. Usage rights and licence
Once paid and approved, the brand gets a non-exclusive licence to use the content on its own social pages, website and paid ads (including Spark Ads, whitelisting and partnership ads) for 12 months from approval, worldwide. Longer or exclusive licences, TV/outdoor use and use by third parties must be agreed and priced in the brief. The creator keeps copyright and may show the work in their portfolio unless the brief says it is confidential. Brands may edit, crop and caption the content but not in a way that misrepresents the creator.
8. Originality
Creators confirm that every portfolio link and delivered video is their own original work, that they have permission from anyone who appears in it, and that it uses no music, footage or trademarks they are not entitled to use. Content made with AI tools must be disclosed to the brand. Creators are responsible for claims arising from content that breaks this section.
9. Code of conduct
No hate speech, harassment, explicit content, false health or financial claims, or content that breaks Kenyan law, including the Computer Misuse and Cybercrimes Act and Communications Authority and ASA advertising rules. Paid content must be disclosed where the platform requires it (for example #ad or the platform’s branded-content label) when the creator posts it. Brands must not ask creators to make misleading claims. Creators and brands must keep job communication and payment through ClipGanji for any job introduced here.
10. Disputes
If a brand and creator disagree about whether content meets the brief, either can raise it with ClipGanji within 5 days of delivery. We review the brief and the delivered work and decide whether to release the payment, request a revision, or refund the brand in full or in part. We aim to settle disputes within 7 working days. If that does not resolve it, the dispute is governed by the laws of Kenya and the courts in Nairobi.
11. Privacy
We collect the details in your profile or request to run the marketplace. A creator’s display name, county, town, rates, niches, languages, portfolio links and social handles are shown publicly once approved. Phone numbers and email addresses are never shown publicly and are shared only as needed to deliver a confirmed job. We handle personal data in line with the Kenya Data Protection Act, 2019. Ask us any time to see, correct or remove your data.
12. Approval and termination
Every creator profile is reviewed before it goes live, and we may decline a profile without giving reasons. Either side may stop using UGC at any time; jobs already confirmed must still be completed or refunded under these terms. We may suspend or remove a profile or brand for breaking these terms, for fraud, or for repeated late or rejected work. Payments owed for approved work are still paid out.
13. Changes
We may update these terms. The date below shows the latest version, and changes do not affect jobs already confirmed.
